8. Any scavenging lanes formed to be handed over to Government free of cost,

Should the Grantee neglect, or fail to comply with these Conditions or any of them, His Majesty, shall be at full liberty to sell the Property either by Public Auction or Private Contract at such time and place and in such manner as to His Majesty shall seem fit, or at the option and pleasure of His Majesty, to re-enter and resume the property as if no grant had ever taken place,

Possession of the Lot

granted shall be given to the Grantee and deemed to have been taken by him, on the date of a letter from the Director of Public Works stating that the Lot is at the disposal of the Grantee,

12. The expression "Grantee " used herein shall in every case include the Grantee or Grantees and where the context so admits or requires his executors, administrators or assigns, and in the case of a corporation its successors or assigns.

13. The foregoing General Conditions shall be read and construed as varied or

modified by the Special Conditions hereinafter contained.

SPECIAL CONDITIONS OF GRANT HEREINBEFORE REFERRED TO.

(a) Except with the consent of the Governor, the lot shall only

be used for the purpose of a temple and buildings in connection therewith.

(b) The whole of the areas coloured red and green on plan shall be

formed by the Grantee at his own expense to such levels as the Director of Public Works may approve within 12 months of the date of a letter signed by the Director of Public Works stating that the area is at the disposal of the Grantee. The area coloured green to be handed over to Government free of cost on completion.

(c) The Grantee will not be allowed to utilize the area coloured

green for the purpose of storage or for the erection of any temporary buildings without the consent of the Director of Public Works first having been obtained.

(d) The Grantee shall construct substantial retaining walls, where

necessary, to obviate landslips in the event of his cutting away the hill to level the site or to protect any filling in connection with the same. Should landslip occur as a result of such cutting or levelling, the Grantee will be held responsible for and shall indemnify the Government and its officers from and against all actions, claims and demands arising out of any damage resulting from or brought about by such landslip.
